Introduction

These Terms of Service ("Terms") are provided by LivingWell Senior Companions, LLC, operating the online marketplace MyTodayAngel.com ("MyTodayAngel," "we," "us," or "our"). These Terms govern your access to and use of our website, mobile applications, and related services (collectively, the "Service"), including the rights, responsibilities, and obligations of all users of the platform.

MyTodayAngel is an online marketplace that connects individuals and families seeking non-medical companionship and everyday support with independent helpers, caregivers, and companions ("Angels"). MyTodayAngel is not a home care agency, healthcare provider, or employer of caregivers, and does not provide caregiving services directly.

By accessing or using the Service, creating an account, posting or responding to listings, booking services, or otherwise using MyTodayAngel, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

Our collection, use, and protection of personal information are governed by our separate Privacy Policy, which is incorporated by reference into these Terms. We encourage you to review the Privacy Policy carefully to understand how your information is handled.

Section 1 — Customer & Companion (Angel) Responsibilities

  • Background Check Requirement
    Each Companion (Angel) is required to complete and maintain a current background check on an annual basis through the MyTodayAngel.com platform. Failure to complete or renew the required background check on time may result in suspension or termination of the Companion's (Angel's) eligibility to provide services through the platform.

  • Provide a Safe Environment
    Customers are responsible for ensuring that the service environment in which the services are provided is safe, clean, and suitable for the Companion (Angel) at all times. This includes, without limitation:

    • Maintaining a smoke-free environment during service hours
    • Ensuring pets are restrained, secured, or kept separate and do not interact with the Companion (Angel) unless expressly agreed in advance
    • Removing or addressing known hazards, including unsafe conditions, aggressive animals, or individuals who may pose a risk
    • Complying with all applicable health, safety, and building regulations

    Failure to provide a safe environment may result in immediate suspension or termination of services without refund.

  • Respectful Conduct
    Customers must treat companions (Angels) with respect and professionalism at all times.

  • Follow Platform Rules
    Customers and Companions (Angels) agree to follow all platform rules, guidelines, policies, and service boundaries.

  • No Off-Platform or Prohibited Requests
    Customers may not request Companions (Angels) to:

    • Perform services outside the platform
    • Break rules or violate policies
    • Engage in unsafe, illegal, or inappropriate activities

Customers and Companions (Angels) agree not to solicit, arrange, or engage in services outside of the platform that originate through the platform. All communications, bookings, and payments must remain within the platform.

We are not responsible or liable for any interactions, services, agreements, or damages arising from relationships or transactions conducted outside of the platform.

We reserve the right to suspend or terminate any account without notice if we determine that a Customer or Companion (Angel) has attempted to or has bypassed the platform to arrange services directly.

Section 2 — Services (What Angels Do)

Promote Independence & Daily Living

  • Encouraging customers to do as much as they can safely
  • Helping maintain daily routines
  • Guiding customers through activities step-by-step
  • Assisting with basic organization, calendars, and reminders
  • Promoting healthy choices such as hydration, meals, and rest
  • Helping with light tasks that reduce stress and support independence

Companionship & Social Support

  • Friendly conversation and emotional support
  • Games, hobbies, puzzles, and activities
  • Reading aloud or writing assistance
  • Memory and mental engagement activities
  • Short walks and community outings
  • Support during social or family outings

Light Household Tasks

  • Light housekeeping (tidying, dishes, dusting)
  • Laundry and folding
  • Light cleaning and organization
  • Bed-making and basic home upkeep

Meal Support

  • Preparing simple meals and snacks
  • Light cooking (non-medical diets only)
  • Assistance with grocery planning

Errands & Outings

  • Grocery shopping and everyday errands
  • Prescription pickup (no medical administration or management)
  • Shopping for household supplies
  • Mailing packages or letters

Transportation & Appointments

  • Transportation to appointments and activities
  • Providing a steadying hand or arm while entering or exiting a vehicle, walking, or navigating curbs or steps, provided the customer can safely bear their own weight
  • Remaining with customers during appointments (if requested)
  • Assistance with planning outings

Safety Awareness

  • Monitoring for fall risks or unsafe conditions
  • Encouraging safe movement and independence
  • Noticing changes in behavior or well-being
  • Contacting family or emergency services, when appropriate
  • Providing general peace of mind for customers and families

Physical Assistance Limitations. Companions (Angels) may provide limited, non-medical, incidental physical assistance to support comfort, safety, and mobility during companionship activities. This may include offering a steadying hand while walking, assisting with entry or exit from a vehicle, or helping with light, non-strenuous personal tasks that do not require specialized training or that do not involve bearing a client's full weight.

Angels may not perform any tasks that require them to lift, carry, transfer, reposition, or otherwise support a customer's full body weight; catch or prevent a fall; or provide hands-on personal care or mobility assistance that requires specialized training or creates a significant risk of injury.

Transportation Requirements. When transportation services are provided, Companions (Angels) are solely responsible for complying with all applicable laws and regulations required for maintaining valid and required driver's licenses, legally registered vehicles, and legally required automobile insurance. Companions (Angels) will immediately stop offering transportation services if any of these requirements are no longer met.

Families and customers are encouraged to discuss transportation arrangements with Companions (Angels) before the first trip and may request confirmation that the Angel holds a valid driver's license and maintains legally registered and insured vehicles.

LivingWell Senior Companions, LLC, and MyTodayAngel do not own, operate, or insure vehicles used by Companions (Angels) and are not responsible for verifying the ongoing validity of a Companion's (Angel's) driver's license, vehicle registration, or insurance coverage.

Section 3 — Services Angels Do Not Provide

To maintain clear service boundaries and ensure safety, the following services are not provided:

  • Medical Care
    No medical services, clinical care, or healthcare decision-making. Companions (Angels) do not diagnose conditions, provide treatment, or determine medication dosages.

  • Medication Administration
    No administration of medication. Companions (Angels) may assist with reminders, reading labels, or handling pre-organized medications, but do not determine or modify dosage.

  • Hands-On Personal Care
    No bathing, toileting, or incontinence care. Light, non-invasive assistance such as reminders or grooming prompts may be provided.

  • Heavy Physical Assistance
    No lifting, transferring, or physical support that requires significant strength or creates risk of injury.
    Companions (Angels) may provide standby assistance, steadying, or guided support, including assistance entering or exiting a vehicle, as long as no full lifting or unsafe physical strain is involved.

  • Therapeutic Services
    No massage, physical therapy, or rehabilitation services.

  • Financial or Legal Activities
    No bill payment, financial management, or witnessing or executing legal documents.

  • Childcare or Unrelated Services
    No childcare or services for individuals who are not the registered customer.

Customers and Companions (Angels) are expected to use reasonable judgment and must not engage in any activity beyond their physical ability or that could pose a risk of injury to anyone.

Section 4 — Booking Cancellation & Rescheduling Policy

To protect customers, families and Companions (Angels) while keeping the marketplace fair, payments for bookings are securely held by Stripe until after the service is completed. The following rules apply to cancellations, refunds, and schedule changes.

  • Customer Cancels More Than 24 Hours Before the Booking: The Customer receives a full refund of the booking amount. The Angel does not receive payment. Platform and processing fees are refunded except for any non-refundable payment processing charges.

  • Customer Cancels Within 24 Hours of the Booking: The Customer is charged the full booking amount. The Angel receives payment for the scheduled service. Platform and payment processing fees are retained.

  • Angel Cancels More Than 24 Hours Before the Booking: The Customer receives a full refund. The Angel does not receive payment. Repeated cancellations may affect the Angel's standing on the platform.

  • Angel Cancels Within 24 Hours of the Booking: The Customer receives a full refund. The Angel does not receive payment. The cancellation may negatively affect the Angel's profile, ranking, or eligibility to continue accepting bookings.

Rescheduling Requests

  • If the Customer requests a new date more than 24 hours before the booking, the Angel may accept or decline it. If both parties agree, the booking can be rescheduled with no penalty. Funds remain securely held for the updated booking date.

  • Rescheduling within 24 hours of the booking is allowed only if both parties agree. If the Angel cannot accommodate the new time, the standard cancellation policy applies.

  • If the Angel requests a new date more than 24 hours before the booking, the Customer may accept or decline the new proposed date. If accepted, the booking remains active, and the funds remain on hold until the rescheduled service is completed. If declined, the Customer receives a full refund.

  • If the Angel requests a new date within 24 hours of the booking, the Customer may accept or decline the new proposed date. If declined, the Customer receives a full refund. Repeated last-minute reschedule requests by Angels may affect their platform standing.

No-Show Policy

  • If the Customer is unavailable or refuses to allow the Angel to complete the service, the booking is considered complete. The Angel receives payment.

  • If the Angel does not show up to complete the service, the Customer receives a full refund. The Angel does not receive payment. The incident may negatively affect the Angel's account standing.

All cancellations must be submitted through the platform using the designated account or booking management features. Cancellations made outside the platform may not be accepted.

Emergency Exceptions. We understand emergencies happen. Documented emergencies, severe illness, unsafe conditions, or extreme weather may qualify for exceptions to standard cancellation penalties at the platform's discretion.

Section 5 — Payment

  • Platform Payments Required
    Customers agree to pay the rate(s) for the requested service(s) and to make all payments through the MyTodayAngel.com platform in accordance with the rates and instructions provided at the time of booking.

  • No Cash Payments
    Cash payments and off-platform transactions are not permitted.

  • Taxes
    Applicable taxes may be billed in accordance with applicable laws, regulations, and statutory requirements.

  • Background Check Fees Are Non-Refundable Any fees paid for background checks, identity verification, screening, or related processing services are non-refundable once payment has been submitted, regardless of whether the applicant is approved, denied, withdraws their application, fails to complete the process, or no longer wishes to use the platform. Background check fees are used to cover third-party screening and administrative processing costs and do not guarantee acceptance, approval, or continued access to the company’s services or platform.

Section 6 — Safety

  • Companions (Angels) and customers must contact 911 during emergencies
  • Customers' homes must be safe, clean, and accessible
  • Customers may not request companions (Angels) to perform unsafe tasks.

Section 7 — Termination

Either party may terminate services at any time, if:

  • The home or service environment is unsafe or poses a risk
  • A customer or companion (Angel) behaves in a disrespectful, inappropriate, or abusive manner toward the other party

MyTodayAngel may also terminate or restrict access to protect the platform's safety, integrity, or reputation, or that of its users. We reserve the right to suspend or terminate access to the platform and/or services immediately if, in our sole discretion:

  • These Terms or platform guidelines are violated or repeatedly disregarded
  • Payment obligations are not met, or transactions are disputed or reversed
  • Termination is necessary to protect the safety, integrity, or reputation of the platform or its users

Effect of Termination Upon termination:

  • Access to the platform may be restricted or removed
  • Any outstanding balances remain due
